Access and use by you of this site constitutes acceptance by you of these Terms and Conditions that take effect from the date of first use. ShopTill-e.com may at any time revise these Terms and Conditions without notice. It is up to you to regularly review the Terms and Conditions in case there are any changes. Continued use of the ShopTill-e.com website after a change has been made is your acceptance of the change. English law shall apply to the contract and the parties agree to submit to the non-exclusive jurisdiction of the English courts.

1. Our Obligations To You

1.1 - Availability - While your account is open and not contravening any of the terms laid out in this agreement ShopTill-e.com is obliged to grant you access to the admin area of your ShopTill-e.com site via a unique username and password. While every effort is made to ensure that the site is available at all times there may be occasions when, due to unforeseen technical difficulties that may affect the server, the internet in general, or other equipment, the site (including the admin area) may be unavailable. ShopTill-e.com makes no representation that the subscribers' area will be available at all times and accepts no liability for any temporary unavailability, for which no refunds will be made.

1.2 - Account Functionality - Should you encounter difficulty accessing the restricted area of the site, ShopTill-e.com is obliged to test your account to verify that the restricted area of the site can be accessed over an open internet connection using your login details when submitted using the latest version of Microsoft's Internet Explorer run in its default settings with Javascript enabled. You are aware of the fact that the settings and configurations of your own software and/or computer may cause problems accessing the restricted area, and that ShopTill-e.com cannot offer support or accept liability for such problems. Once ShopTill-e.com has verified that your account can be accessed using the appropriate software and settings it is your responsibility to ensure that you have the necessary equipment and configuration to use your account. No representation is made that accounts can be accessed from any combination of computer, software, and settings, and (since the necessary software may be freely obtained) no refund can be given for any problems encountered due to the use of inappropriate software/settings. You acknowledge and accept that if your account is tested and found to be working that any problem you continue to encounter is a problem with your own equipment and not the responsibility of ShopTill-e.com.

1.3 - Account Security - ShopTill-e.com is obliged to take all reasonable precautions to ensure that your account is secure and that your personal details are not accessible to any third party operating in the normal course of business. With regard to your payment card details, these will be held securely by your elected payment processor, and will not be available via the ShopTill-e.com site. All information exchanges including your card details will be carried out over secure connections. With regard to less sensitive personal information, such as your name, address, etc. this will be accessible by you using your username and password via the ShopTill-e.com website over a standard internet connection. Your ShopTill-e.com username and password may be sent to you by standard email and may appear on screens within the restricted area accessed with your username and password. Details of account status and date of termination can be obtained with your username only. Your ShopTill-e.com username and password will not allow anyone to see your card details, or initiate any payment on your card, unless you have deliberately made your ShopTill-e.com username and password the same as your username and password for your account with your payment processor. ShopTill-e.com advises strongly against doing so, and if you choose to do so it is at your own risk.

ShopTill-e.com accepts no responsibility for and cannot be held liable for any losses arising from loss of data or the compromising of sensitive data as a result of actions beyond its control, including (but not limited to) hardware failure, software failure, or malicious attacks by third parties.

1.4 - Accuracy of information - ShopTill-e.com is obliged to provide information that is correct to the best of its knowledge, and to follow up any notifications of errors in a reasonable timeframe. However, ShopTill-e.com cannot be held liable for any errors or inaccuracies in its databases, or any loss that may arise from a user acting on information provided by ShopTill-e.com. Inclusion does not constitute recommendation and any action you undertake in relation to any information provided by ShopTill-e.com is undertaken entirely at your own risk.

1.5 - Shop data - ShopTill-e.com offers users the ability to store information on its website, such as photos, product descriptions, pages, etc. This facility is provided for convenience only and should not be relied upon as the sole repository of any important information. It is each user's responsibility to back-up and keep their own copy of any information they wish to keep. ShopTill-e.com cannot be held liable for any loss of information. Information cannot be retrieved and will not be supplied if an account is inactive or terminated. By cancelling your ShopTill-e.com account you will immediately lose access to any stored information.

2. Your Obligations To Us

2.1 - Email Address - To activate your account and gain access to the restricted areas of the site you are required to provide an active email address capable of receiving emails from ShopTill-e.com. You have no right to access the site if you register with a fake and/or invalid email address.

2.2 - Changes to Email Address - Should you at any point stop being able to receive emails at the address you provide, it is your responsibility to amend your account email address via your personal admin area.

2.3 - Payments - By taking out a subscription to ShopTill-e.com you agree to pay for any service rendered, including but not limited to account creation and the maintenance of your account.

2.4 - Late Payments - ShopTill-e.com does not offer a free credit facility. All payments must be settled when they become due. If any payment (or any part of any payment) owed by you under any of the terms of this agreement remains unpaid one week after it becomes due, ShopTill-e.com reserves the right to remove your account and associated data completely.

2.5 - Account Security - As a subscriber to ShopTill-e.com you must keep your login details secret at all times and never share them with any other person.

3. Account Duration and Termination

3.1 Free Trial Period - A free trial period of 14 Days is granted to new users. Should you wish to continue using the services of ShopTill-e.com, you are required to pay a subscription fee. Should you not pay the subscription fee, your account will be deactivated and all associated data and files removed from our system entirely.

3.2 - Duration - Your account will remain active from the point at which you activate your account to the point at which your subscription is cancelled in accordance with any of the points detailed below (excepting suspensions imposed due to account misuse or suspected account misuse at ShopTill-e.com's discretion).

3.3 - Subscription Failure - If a due subscription payment fails to be made your account will be closed one week after the payment failed. Potential reasons for subscription payments failing include the card from which payments are made expiring, being cancelled, or having insufficient funds available.

3.4 - Subscription Cancellation - Once your account or subscription has been cancelled all your data will be removed from the ShopTill-e.com system immediately.

3.5 - Account Misuse - ShopTill-e.com reserves the right to close without warning any accounts being used for any other purpose than for the provision of information and photos related to your website & ePOS. Possible forms of misuse include, but are not restricted to the following: (i) Data theft - information provided is for the benefit of the individual subscriber only, and must not be shared, published, or otherwise disseminated in any way; (ii) incorrect information - if the information you provide about yourself is false or incorrect you may be denied access to your account or your account may be closed. This applies in particular to the sign-up process where the use of a false or inaccurate email address, or one which cannot receive emails from ShopTill-e.com, will render you unable to activate your account, for which we accept no responsibility and for which no refunds will be issued.

3.6 - Money-Off Offers - ShopTill-e.com offers money off vouchers from time to time. These offers are valid for the stated period only and do not carry over to subsequent subscription payments.

5. Policies

5.1 - Cancellation/Returns/Refunds Policy - Subscriptions are non-refundable. Should you cancel your account, a refund will not be given for the balance of your subscription. No refunds will be given for any accounts closed due to misuse.

5.2 - Delivery Policy - As subscriptions are not deliverable, your account and services do not include delivery.

5.3 - Privacy Policy - We collect personally identifiable data (PID) about you that you specifically and voluntarily provide. We endeavour to collect only the minimum PID to provide the service that you request. By registering your PID you expressly give permission to us to contact you regarding the goods and services we supply. We do not sell or rent your PID to anybody. We may be required by law to disclose information you have provided to conform to the law and legal authorities.

5.4 - Data Processor - If you have a ShopTill-e account your are a client of Electric Media Limited. The data collected from your customers will be stored on ShopTill-e servers. You are the ‘data controller’ of all of your customer data and you decide the purpose and manner in which personal data is or will be used. Whilst you are subscribed to ShopTill-e’s services, you retain ownership of and have control over that data.

ShopTill-e is a ‘Data Processors’; the security of the ShopTill-e platform is a fundamental aspect of the services we provide and we have a range of appropriate measures in place to protect the system and the personal information stored on our servers.

With regard to all personal data , as defined in the General Data Protection Regulations ('GDPR'), the you the Client agrees to be responsible as Data Controller, as defined in the GDPR, of such data, for determining what personal data, is to be obtained and retained, for how long and for what purpose, and for the obtaining of the necessary consents and ,as a result, for complying with the GDPR and any other legislation enforcing obligations and duties on any person or body responsible for the handling of personal data . For the avoidance of doubt Electric Media does not monitor and has no liability for the contents of any communications transmitted via the System.

Further the Client fully indemnifies and shall keep indemnified Electric Media for all losses and damages flowing from any liability imposed upon them arising out of the handling of personal data by it, under instruction from the Client, or by the Client.

The Client shall as soon as reasonably practicable notify Electric Media in writing of any claim made against it by a third party which may give rise to a claim for breach of this warranty but any failure to give such notice shall not affect the rights of Electric Media.

We will comply in all respect with the duties upon us as data processors to comply fully with the General Data Protection Regulation and, in particular, to provide, on request, and as a contractually binding representation to you, all information you deem is required by you from ourselves of the nature as set out under Article 28 of the General Data Protection Regulation.

6. Technical Requirements

To use ShopTill-e.com's services you will need certain equipment, not supplied by ShopTill-e.com. This includes a computer, an internet connection, and the necessary software to browse the internet and access emails. ShopTill-e.com is designed for and tested with Google Chrome, Mozilla Firefox, Safari & Opera run in their default settings with Javascript enabled. Performance on other applications cannot be guaranteed, and no assurance can be provided that ShopTill-e.com services can be used with any configuration of computer, software, and settings. The necessary programs to utilise ShopTill-e.com services are available for free on the internet, and as such no refund can be made for any failure of your own equipment to receive, process, and correctly display ShopTill-e.com services.
